The following terms apply to all users of the TextMagic service, operated by TextMagic Limited.

Messages are normally delivered within a few seconds, as long as the receiving phone is in coverage. We cannot guarantee this delivery time though, since it depends on network conditions outside our control.

You must not use our service to send threatening or abusive messages.

You can use our service to send advertising messages, as long as the recipient has requested them, can easily opt-out, and you follow the MMA's Code of Conduct for Mobile Marketing.

If you abuse our service, we may suspend your account without refunding any unused message credit.

Should you stop using your account, we may close it without refunding any unused message credit. We'll always warn you by email before we do this, and allow you to keep it open.

For each visitor to our Web page, our Web server automatically recognizes IP number.

We collect the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, information volunteered by the consumer, such as survey information and/or site registrations, name and address.

The information we collect is used to improve the content of our Web page and our online text messaging services.

If you are concerned about how your information is used, you should check back at our Web site periodically, we will post the policy changes to our Web site to notify you of these changes and we will use for these new purposes only data collected from the time of the policy change forward.

Upon request we provide site visitors with access to all information [including proprietary information] that we maintain about them, unique identifier information (e.g., customer number or password) that we maintain about them, transaction information (e.g., dates on which customers made purchases, amounts and types of purchases) that we maintain about them, communications that the consumer/visitor has directed to our site (e.g., e-mails, customer inquiries), contact information (e.g., name, address, phone number) that we maintain about them.

Our system tracks the text messages you send and numbers you send to. This data is accessible to you, the customer, through a secure connection. The information is held in a secure environment and is only accessible to the employees of TextMagic Ltd. We do not provide this information to any third party except when formally requested by the Police or when investigating a delivery problem on your behalf.

We do not sell or use any of this personal information outside of our company. We do not disclose your personal information to any third party unless compelled by law. All of our employees who have access to your personal information are obliged to keep it confidential.

With respect to security: We have appropriate security measures in place in our server hosting facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.
